Court to rehear Kamehameha admissions case

The U.S. 9th Circuit Court of Appeals will rehear the case involving a
non-Hawaiian student seeking to enroll at Kamehameha Schools.
The ruling today is a blow to the hopes of the unnamed non-Hawaiian student
seeking to gain entrance to the school whose policy is aimed at admitting only
students with Hawaiian blood.
The decision essentially sets aside for now a 2-1 decision by a three-member
panel of the court that ruled in favor of the non-Hawaiian student on Aug. 2.
The majority opinion in that panel's ruling declared that the school admission
policy violated federal civil rights law.
Lawyers for the student had argued the admission policy violates federal
laws, while school supporters said the policy is necessary to address social,
educational and economic disadvantages faced by Native Hawaiians.
In a brief order, the appeals court said the decision to rehear the case was
based on a vote by a majority of the active 9th Circuit judges who did not
disqualify themselves from the case.
The non-Hawaiian student, who has not been identified, is currently a senior
attending another school. He wanted to enroll at Kamehameha before he graduates
this year.
Because Kamehameha Schools challenged the ruling and asked for a rehearing,
the enforcement of the 2-1 decision was stayed and the student was not permitted
to enroll at Kamehameha.
By granting the rehearing request, a panel of 15 appeals judges will be
rehearing the case, according to Kamehameha spokesman Kekoa Paulsen.
Today's order said the 2-1 decision cannot be cited as precedent pending the
ruling by the larger panel.
It was not immediately clear when the larger panel will rehear the case or
when it will issue a decision.
Kamehameha officials were pleased with the development.
Robert Kihune, chairman of the Kamehameha Board of Trustees, said the
decision "signals that the appeals court agrees that this lawsuit raises unique
issues of exceptional importance to Native Hawaiians."
Kihune added: "We are hopeful that when the case is reheard the court will
reverse the panel decision and allow Kamehameha to continue to direct our
resources to those children who are in need of our programs and are the intended
beneficiaries of this trust."
Kamehameha chief executive officer Dee Jay Mailer said the preference policy
is critical to fulfilling the school's educational mission as spelled out by its
founder, Princess Bernice Pauahi Bishop, as it endeavors to extend its reach
further into Hawaiian communities.
"Pauahi felt a kuleana (responsibility) to provide educational opportunities
for the Hawaiian people," Mailer said. "She entrusted that kuleana to the
leadership of Kamehameha Schools. We will not let her
down."

(AHN) - Canadian cyclist and 2008 Olympic hopeful Kristen Worley
reveals that she had sex-reassignment surgery to change her gender from
male to female, reports MSNBC.com. Worley
has been talking about
her gender change to sports organizations in Canada in the hopes of
receiving permission to compete in the Beijing Olympic games. She
speaks publicly about her gender for the first time to MSNBC.com. Worley
says, “I shouldn’t be worrying about what people are going to do when
they find out, but I’m so afraid." She adds, “I'm just like any other
girl there.”International
Olympic Committee rules instituted in 2004 say a transsexual athlete
must wait two years after sex-change surgery before competing. Helen
Carroll, sports project coordinator for the San Francisco-based
National Center for Lesbian Rights, says to MSNBC.com: The new IOC rule
"set a precedent for other organizations. She adds, "The U.S.
Track and Field Organization has adopted rules very similar to the IOC
ruling. Australia and Europe changed their professional women’s golf
rules so that Mianne Bagger could compete.” No athlete in an
Olympic game has ever admitted to being transsexual. Worley says she
expects a backlash from fellow cyclists now that her sex change is
public. However, she says: “This could not be a more important issue — for sports and for society.”
Oahu Dines is right
around the corner
Oahu Dines is an annual event where Oahu
restaurants have the opportunity to join Life Foundation in the fight
against AIDS. Restaurants participating in Oahu Dines donate a portion of
their sales on March 1, 2006 to benefit Life Foundation and promote
HIV/AIDS awareness in Hawai’i. This year Sonny Ching is partnering with
Olena Rubin, host of OC16’s Countdown Hawaii, and presenting Oahu
Dines.
Several of the restaurants that participated
last year have already signed on for 2006, including Big City Diner, as
well as new participants, including El Charro II Mexican Seafood

.......The main themes of The
Glades Project center around the basic civil rights of an oppressed and
under represented Asian / Pacific Islander-Hawaiian group of people.
Oppression on any level creates unnecessary suffering for everyone, not
just those in the target group. This documentary will show how scores
of people in the Hawai`i community struggled during the 1960s, 70s and
80s and how they managed to emerge and survive. This film will also act
as a vehicle for healing by allowing the men and women of the past to
express their personal hidden truths, many for the very first
time.

The Glades Project began with prompting from elders within the community to look into an era of Honolulu’s diverse history where no comprehensive research work has ever been done before. The Glade Show Club, located at 152 N.Hotel Street and operating from the 1960s -70s-80's, served as a gathering place for Mahus/transgendered community. The Glades Project is an ongoing research of The Glade Show Club and the people who frequented it, performer and patron alike, and will result in a documentary film, including the creation of many historical archival research resources. Living histories are being recorded through extensive interviews. Hula Girl Productions has finished a cross country trip this summer taking them through New York, Chicago, Southern California and Las Vegas speaking with people connected to The Glades, entertainers and patrons, all people familiar with Old Chinatown during the 60s and 70s. and 80's.
There is a need for photographs, commemorative items, printed materials such as original newspaper articles, wardrobe from the shows, and film of The Glade Show Club and performances, along with Old Chinatown. Your kokua is greatly appreciated in this unparalleled endeavor.

community, and educate society, and as i pass on my responsibilities, i hope
only the best of success to my successor, the rest is still unwritten and now
its up to you to make a difference. it was a rough year for me, had alot of set
backs, but through all of your love and support, i have been able to overcome
even the most trialsome of times. my heart hasnt completely been healed, i just
need a few more pieces for my bridge, then i'll be over it! Whether you are able
to attend or not, my love is unconditional and i thank ke akua for the many
wonderful blessings that has bestowed upon me....if you are reading this, that

I will be running in this years Miss Ke Ala O
Ka Malamalama Pageant 2006 on Maui at Historic Iao Theater.. Last Year
I had the Honor to run up against the most talented Mahus. . . . You
know this was a night I will never forget all us sister's sharing our
mana'o helping one another out backstage sharing stories and laughs to
last a life time and OMG to even say that rite across of me at our
Hotel Lukela and My Drag Mother Victoria VonDrake at the time Good
Friend was staying We gave it to that hotel trust, Where in the hell
will you find Mahus early in the morning from other islands
running accross the courtyard with wigs in there hand and full face on
that was the time of my life,,,
I would like to take the time now to Congradulate Molokai's finest MAHU
Miss Tyra Dudiot For taking the Crown She Got what was well deserved.
And to think She would go to Kulia Na Mamo's Retreat and also Take the
Diva Of Kaena Crown too LOVE YOU SIS I had a blast helping you out with
